CONDICIONES DE CONTRATACIÓN

1.INTRODUCCIÓN

El presente documento tiene por finalidad regular las CONDICIONES GENERALES DE CONTRATACIÓN de los servicios de reserva (en adelante los servicios) de ALBERGUE KM. 0 S.L. (en adelante THOSTEL SANTIAGO), con domicilio social en calle Rúa de Boiro 3 Bajo, 15705 Santiago de Compostela (A Coruña), CIF B70536768 y teléfono 0034 881 240 444. El término “Usuario/a" se emplea aquí para referirse a todos los individuos y/o entidades que por cualquier razón se registren en www.thostelsantiago.com o utilicen sus servicios.

2. USO DE LOS SERVICIOS DE RESERVA ON-LINE DE THOSTEL SANTIAGO

1. Los servicios de reserva on-line tienen por finalidad la reserva de una cama en una habitacion mixta compartida de 4 camas, 6 camas u 8 camas en el THOSTEL SANTIAGO, que se reserva el derecho a decidir la ubicación concreta de la cama en dicha habitación, por motivos de organización. La utilización de estos servicios supondrá la aceptación plena y sin reservas, y la validez, de todas y cada una de las Condiciones de Contratación, que se considerarán automáticamente incorporadas en el contrato que se suscriba con THOSTEL SANTIAGO, sin que sea necesaria su transcripción escrita en el mismo de estas CONDICIONES GENERALES. Los precios de la cama incluyen el IVA y otras tasas si las hubiere.
2. Procedimiento de contratación: Durante el proceso de realización de la reserva, el/la usuario/a deberá cubrir unos datos imprescindibles para la realización de esta (Nombre, Primer Apellido, número de DNI o pasaporte, email y Télefono). El/la usuario/a garantiza que es mayor de dieciocho (18) años y que los datos que facilita son verdaderos, exactos, completos y actualizados. Una vez hecho el pago de la reserva mediante tarjeta de crédito el/la usuario/a recibirá un correo electrónico con la confirmación de esta. Este email le sirve como comprobante de su reserva. Para que una reserva se considere confirmada es requisito IMPRESCINDIBLE haber efectuado el pago de la reserva. En THOSTEL SANTIAGO trabajamos para que no se produzcan errores durante el proceso de reservas on-line, pero si el usuario detecta algún error durante este proceso puede ponerse en contacto por email a info@thostelsantiago.com
3. El coste del alojamiento incluye: lencería (sábanas de tela, y manta), utilización de taquillas, agua caliente en duchas y lavabos, uso de cocina y comedor, Wifi .

3. REGISTRO DE ENTRADA Y HORARIO DE SALIDA

1. El registro de entrada se realizará desde las 14:00 hasta las 18:00 horas del día de llegada (hora local del albergue). Fuera de ese horario la recepción está cerrada y no será posible hacer el registro de entrada. En caso de no presentarse en el albergue en ese horario de recepción se cobrará el TOTAL de la estancia (IVA y tasas incluidas) y THOSTEL SANTIAGO dispondrá libremente de las camas implicadas en la reserva. Si por alguna razón, quedara pendiente, parte del importe total de la reserva se deberá abonar en el momento del registro de entrada. Para realizar el registro de entrada todos los beneficiarios de la reserva mayores de catorce (14) años deben presentar un documento de identidad con foto, carné de conducir o pasaporte. Los ciudadanos/as de fuera de la Unión Europea solo podrán hacer el registro de entrada con el pasaporte. ( Ley Orgánica 4/2015, de 30 de marzo, de protección de la seguridad ciudadana y Orden INT/502/2003 de 21 de febrero y Orden INT/1922/2003 de 3 de julio) En el caso de grupos de menores de edad deberán ir acompañados de adultos. Para mayores de seis años, una persona adulta por cada veinte menores. Si son niños/as de seis años o menos, deberá acompañarlos un adulto por cada diez menores. Después de hacer el registro de entrada en el albergue se podrá entrar libremente hasta la hora de salida (Check OUT) con un código PIN que se proporciona a la llegada.
2. El/la usuario/a se compromete a abandonar el albergue antes de las 10:00 horas del día de salida (hora local del albergue).

4. MODIFICACIÓN O CANCELACIÓN DE LA RESERVA

Si el/la usuario/a anula su reserva, la anulación podrá tener como consecuencia gastos de anulación, que cubren los gastos y perjuicios devengados por la no ocupación de las plazas reservadas y anulada antelación a la fecha prevista de llegada, así como los gastos originados por contrataciones o compra de suministros para la instalación. Los gastos se cobrarán en los siguientes plazos y condiciones:

• 7 o menos días antes de la fecha del registro de entrada: 100 % del importe de la reserva.

La reintegración del importe de la reserva, previo descuento de los gastos de anulación si los hubiera, se hará en un plazo máximo de 30 días (Artículo 14 del Decreto 17/2011 de 8 de septiembre).

5. DATOS PERSONALES

Durante el proceso de reserva online hemos solicitado al usuario/a una serie de datos personales con el fin de prestar el servicio solicitado y/o realizar la facturación de este. Los datos proporcionados se conservarán mientras se mantenga la relación comercial o durante los años necesarios para cumplir con las obligaciones legales (artículos 66 a 70 Ley General Tributaria).

Los datos que se le solicitan resultan necesarios, de manera que de no facilitarlos no será posible la prestación del servicio requerido Los datos no se cederán a terceros salvo en los casos en que exista una obligación legal.

Usted tiene derecho a obtener confirmación sobre si en THOSTEL SANTIAGO (ALBERGUE KM. 0 S.L) estamos tratando sus datos personales por tanto tiene derecho a acceder a sus datos personales, rectificar los datos inexactos o solicitar su supresión cuando los datos ya no sean necesarios, a la limitación de su tratamiento, o a oponerse al tratamiento, así como al derecho de la portabilidad de los datos.

Los datos proporcionados se conservarán mientras se mantenga la relación comercial o durante los años necesarios para cumplir con las obligaciones legales (artículos 66 a 70 Ley General Tributaria).

Los datos que se le solicitan resultan necesarios, de manera que de no facilitarlos no será posible la prestación del servicio requerido Los datos no se cederán a terceros salvo en los casos en que exista una obligación legal.

Mediante la aceptación de la presente Política de Privacidad, el usuario queda informado y presta su consentimiento libre, informado, específico e inequívoco para que los datos personales que facilite a través de la página web ubicada en la URL www.thostelsantiago.com en adelante, el “Sitio Web”) sean tratados por ALBERGUE KM. 0 S. L., así como los datos derivados de su navegación y aquellos otros datos que pueda facilitar en un futuro a ALBERGUE KM. 0 S. L.

El usuario debe leer esta Política de Privacidad cuidadosamente, que ha sido escrita de forma clara y sencilla, para facilitar su comprensión, determinando libre y voluntariamente si desea facilitar sus datos personales a ALBERGUE KM. 0 S. L.

3. OBLIGATORIEDAD DE FACILITAR LOS DATOS.

Los datos solicitados en los formularios del Sitio Web son con carácter general, obligatorios (salvo que en el campo requerido se especifique lo contrario) para cumplir con las finalidades establecidas. Por lo tanto, si no se facilitan los mismos o no se facilitan correctamente no podrán atenderse las mismas, sin perjuicio de que podrá visualizar libremente el contenido del Sitio Web.

4. ¿CON QUÉ FINALIDAD TRATARÁ ALBERGUE KM. 0 S. L. LOS DATOS PERSONALES DEL USUARIO?

Datos facilitados para la realización de reservas, tanto a través del Sitio Web como de email para reservas individuales o de grupos: Gestionar la realización de las reservas solicitadas por el usuario Envío de la confirmación o documentación de la reserva realizada En el supuesto de prestar el consentimiento para ello, el envío de comunicaciones comerciales por parte de  ALBERGUE KM. 0 S. L. Efectuar análisis sobre la utilización del Sitio Web y comprobar las preferencias y comportamiento de los usuarios.
2. Datos facilitados para darse de alta como usuario registrado  en  ALBERGUE KM. 0 S. L.: Gestionar su solicitud de alta o baja dentro de la modalidad elegida por el usuario.  Verificar que el usuario cumple con las exigencias para darse de alta dentro de la modalidad seleccionada, siempre que ALBERGUE KM. 0 S. L. lo considere conveniente.  Trámite y respuesta a las posibles solicitudes de información que realice el usuario.  Búsqueda de promociones que se ajusten a las necesidades que el usuario seleccione.  Para el envío de comunicaciones comerciales personalizadas por parte de ALBERGUE KM. 0 S. L.. Efectuar análisis sobre la utilización del Sitio Web y comprobar las preferencias y comportamiento de los usuarios.
3. Datos facilitados para publicaciones en los  BLOGs  titularidad d e ALBERGUE KM. 0 S. L.: Gestionar la publicación de sus comentarios en el Sitio Web. Gestionar la suscripción y/o baja a la Newsletter del blog a solicitud del usuario. Efectuar análisis sobre la utilización del Sitio Web y comprobar las preferencias y comportamiento de los usuarios. En el supuesto de que ello sea necesario, realizar un control del contenido de los comentarios de los usuarios y, en su caso, eliminar aquellos cuyo contenido no se adecúe a las condiciones aplicables al presente Sitio Web a criterio de  ALBERGUE KM. 0 S. L..
4. Datos facilitados para la modificación y cancelación de reservas: Gestionar de las solicitudes de modificación o cancelación de sus reservas solicitadas por el usuario a ALBERGUE KM. 0 S. L.. Remitirle la contestación a la solicitud planteada a ALBERGUE KM. 0 S. L.. Efectuar análisis sobre la utilización del Sitio Web y comprobar las preferencias y comportamiento de los usuarios.
5. Datos proporcionados en los formularios de contacto y página web: Gestionar las solicitudes de contacto e información del usuario a través de los canales dispuestos para ello en los sitios web de ALBERGUE KM. 0 S. L. Gestión de la petición planteada. Efectuar análisis sobre la utilización del Sitio Web y comprobar las preferencias y comportamiento de los usuarios.
6. Datos proporcionados en el formulario de recuperación de reservas: Envío del recordatorio de la reserva no finalizada por el usuario o, en su caso, de las búsquedas realizadas por el usuario Efectuar análisis sobre la utilización del Sitio Web y comprobar las preferencias y comportamiento de los usuarios.

5. ¿QUÉ DATOS DEL USUARIO TRATARÁ ALBERGUE KM. 0 S. L.?

ALBERGUE KM. 0 S. L. tratará las siguientes categorías de datos del usuario:

1. Datos facilitados para la realización de reservas, tanto a través del Sitio Web como de email para reservas individuales o de grupos: Datos identificativos: nombre, apellidos, nacionalidad. Datos de contacto: dirección de correo electrónico, número de teléfono. Datos de transacción de bienes y servicios en ALBERGUE KM. 0 S. L.: Productos y servicios adquiridos o sobre los que muestres interés. Preferencias de estancia. Datos económicos, financiero y de seguros. Otros datos: datos facilitados por los propios interesados en los campos abiertos o a través de la llamada realizada Datos de navegación.
2. Datos facilitados para darse de alta como usuario registrado en ALBERGUE KM. 0 S. L.: Datos identificativos: nombre, apellidos, domicilio, nacionalidad. Datos de contacto: dirección de correo electrónico, número de teléfono.  Códigos o claves de identificación de usuario y/o titular. Datos de detalle de empleo: profesión, sector.
3. Datos facilitados para publicaciones en los BLOGs titularidad de ALBERGUE KM. 0 S. L. Datos identificativos: nombre, apellidos. Datos de contacto: país de residencia, dirección de correo electrónico. Datos de navegación.
4. Datos facilitados para la modificación y cancelación de reservas: Datos identificativos: nombre, apellidos Datos de contacto: dirección de correo electrónico, número de teléfono. Datos de transacción de bienes y servicios Datos económicos, financiero y de seguros. Otros datos: datos facilitados por los propios interesados en los campos abiertos de los formularios dispuestos en el Sitio Web o en los documentos adjuntos. Datos de navegación.
5. Datos proporcionados en los formularios de contacto y página web: Datos de identificación: nombre, apellidos Datos de contacto: dirección de correo electrónico, número de teléfono. Datos de transacción de bienes y servicios en ALBERGUE KM. 0 S. L.: Datos económicos, financiero y de seguros. Otros datos: datos facilitados por los propios interesados en los campos abiertos de los formularios dispuestos en el Sitio Web o en los documentos adjuntos. Datos de navegación.
6. Datos proporcionados en el formulario de recuperación de reservas: Datos de contacto: dirección y correo electrónico.

6. ¿CUÁL ES LA LEGITIMACIÓN DEL TRATAMIENTO DE LOS DATOS DEL USUARIO?

La legitimación del tratamiento de sus datos personales, serán las siguientes:

• Para la realización de reservas, tanto a través del Sitio Web como de email para reservas individuales o de grupos: la ejecución del contrato entre las partes. Para la ejecución de análisis sobre la utilización de la web, el interés legítimo de ALBERGUE KM. 0 S. L.
• Para la gestión del alta como usuario registrado en el consentimiento solicitado y, en los supuestos de verificación cumplimiento de las condiciones por parte del usuario, así como para la ejecución de análisis sobre la utilización de la web, el interés legítimo de ALBERGUE KM. 0 S. L.. No obstante, en caso de retirar su consentimiento, ello no afectará a la licitud de los tratamientos efectuados con anterioridad.
• Para la gestión y publicación de los comentarios o publicaciones enviados por los usuarios en los  BLOGs titularidad de ALBERGUE KM. 0 S. L.: en el consentimiento prestado por el usuario y, en los supuestos de ejecución de análisis del Sitio Web, comprobar las preferencias y comportamientos de los usuarios, así como realizar un control del contenido de los comentarios, interés legítimo de ALBERGUE KM. 0 S. L. En caso de retirar su consentimiento al tratamiento de publicación de los comentarios, el mismo será eliminado por ALBERGUE KM. 0 S. L. del Sitio Web.
• Para  la  modificación y/o cancelación de su reserva en la ejecución del contrato entre las partes. Para la ejecución de análisis sobre la utilización de la web, el interés legítimo de ALBERGUE KM. 0 S. L..
• Para el envío de los formularios de contacto y página web: en el consentimiento prestado por el usuario. Para la ejecución de análisis sobre la utilización de la web, el interés legítimo de ALBERGUE KM. 0 S. L.
• Para el envío del recordatorio de recuperación de reservas: en el consentimiento prestado por el usuario. Para la ejecución de análisis sobre la utilización de la web, el interés legítimo de ALBERGUE KM. 0 S. L.. Los consentimientos obtenidos para las finalidades mencionadas son independientes por lo que el usuario podrá revocar solo uno de ellos no afectando a los demás.
• Para revocar dicho consentimiento, el Usuario podrá contactar con ALBERGUE KM. 0 S. L.. a través de un email a info@thostelsantiago.com

7. ¿CON QUÉ DESTINATARIOS SE COMPARTIRÁN LOS DATOS DEL USUARIO?

Adicionalmente, los datos podrán ser accesibles por proveedores de ALBERGUE KM. 0 S. L., siendo dicho acceso el necesario para el adecuado cumplimiento de las obligaciones legales y/o de las finalidades anteriormente indicadas. Dichos proveedores no tratarán sus datos para finalidades propias que no hayan sido previamente informadas por ALBERGUE KM. 0 S. L..

8. TRANSFERENCIAS INTERNACIONALES DE DATOS

No se realizan transferencias internacionales de datos.

9. CONSERVACIÓN DE LOS DATOS

Sus datos serán conservados durante los siguientes plazos:

• Datos facilitados para la  realización de reservas, tanto a través del Sitio Web como de email para reservas individuales o de grupos: serán conservados durante la relación contractual y, una vez finalizada la misma, durante el plazo de prescripción de las acciones legales que se puedan derivar de la misma.
• Datos facilitados para darse de alta como usuario registrado  en  ALBERGUE KM. 0 S. L.: en tanto en cuanto el usuario no revoque el consentimiento prestado. No obstante, en caso de retirar su consentimiento, ello no afectará a la licitud de los tratamientos efectuados con anterioridad.
• Datos facilitados para publicaciones en los BLOGs titularidad de ALBERGUE KM. 0 S. L.: Los datos serán conservados en tanto en cuanto el usuario no revoque el consentimiento otorgado.
• Datos facilitados para la modificación y cancelación de reservas: serán conservados durante la relación contractual y, una vez finalizada la misma, durante el plazo de prescripción de las acciones legales que se puedan derivar de la misma.
• Datos proporcionados en los formularios de contacto y página web: serán conservados durante el plazo necesario para dar trámite y contestación a su solicitud y, una vez finalizado el mismo, durante el plazo de prescripción de las acciones legales derivadas de la citada solicitud.

10. RESPONSABILIDAD DEL USUARIO.

El usuario:

• Garantiza que es mayor de dieciocho (18) años y que los datos que facilita a ALBERGUE KM. 0 S. L. son verdaderos, exactos, completos y actualizados. A estos efectos, el usuario responde de la veracidad de todos los datos que comunique y mantendrá convenientemente actualizada la información facilitada, de tal forma que responda a su situación real.
• Garantiza que ha informado a los terceros de los que facilite sus datos, en caso de hacerlo, de los aspectos contenidos en este documento. Asimismo, garantiza que ha obtenido su autorización para facilitar sus datos a ALBERGUE KM. 0 S. L. para los fines señalados.
• Será responsable de las informaciones falsas o inexactas que proporcione a través del Sitio Web y de los daños y perjuicios, directos o indirectos, que ello cause a ALBERGUE KM. 0 S. L. o a terceros

11. EJERCICIO DE DERECHOS.

El usuario puede enviar un escrito a ALBERGUE KM. 0 S. L., a la dirección indicada en el encabezado de la presente Política, o bien por medio de un correo electrónico a info@thostelsantiago.com adjuntando fotocopia de su documento de identidad, en cualquier momento y de manera gratuita, para:

• Revocar los consentimientos otorgados.
• Obtener confirmación acerca de si en ALBERGUE KM. 0 S. L. se están tratando datos personales que conciernen al usuario o no.
• Acceder a sus datos personales.
• Rectificar los datos inexactos o incompletos. Solicitar la supresión de sus datos cuando, entre otros motivos, los datos ya no sean necesarios para los fines que fueron recogidos.
• Obtener de ALBERGUE KM. 0 S. L. la limitación del tratamiento de los datos cuando se cumpla alguna de las condiciones previstas en la normativa de protección de datos.
• Solicitar la portabilidad de los datos facilitados por el Usuario en aquellos casos previstos en la normativa.
• Interponer una reclamación relativa a la protección de sus datos personales ante la Agencia Española de Protección de Datos en la dirección Calle de Jorge Juan, 6, 28001 Madrid, cuando el interesado considere que ALBERGUE KM. 0 S. L. ha vulnerado los derechos que le son reconocidos por la normativa aplicable en protección de datos.

12. MEDIDAS DE SEGURIDAD

ALBERGUE KM. 0 S. L. tratará los datos del usuario en todo momento de forma absolutamente confidencial y guardando el preceptivo deber de secreto respecto de los mismos, de conformidad con lo previsto en la normativa de aplicación, adoptando al efecto las medidas de índole técnica y organizativas necesarias que garanticen la seguridad de sus datos y eviten su alteración, pérdida, tratamiento o acceso no autorizado, habida cuenta del estado de la tecnología, la naturaleza de los datos almacenados y los riesgos a que están expuestos.

GENERAL CONTRACTING CONDITIONS

1.INTRODUCTION

The purpose of this document is to regulate the GENERAL CONTRACTING CONDITIONS of the Online Booking services (hereafter, ‘Online Booking’ services, or ‘services’) of ALBERGUE KM. 0 S.L. (hereafter THOSTEL SANTIAGO), with registered offices in Rúa de Boiro 3 Bajo, 15705 Santiago de Compostela (A Coruña), Tax ID number B70536768 and phone 0034 881 240 444. he terms “You” and “User” are used here to refer to all individuals and/or entities who for whatever reason access www.thostelsantiago.com or use its services.

2. USE OF THE THOSTEL SANTIAGO ONLINE BOOKING SERVICES

1. The purpose of the online reservation services is to reserve a bed in a shared mixed room with 4 beds, 6 beds or 8 beds at the THOSTEL SANTIAGO, which reserves the right to decide the specific location of the bed in said room, for organizational reasons. The use of these services will imply the full and unreserved acceptance, and the validity, of each and every one of the Contract Conditions, which will be considered automatically incorporated into the contract signed with THOSTEL SANTIAGO, without the need for a written transcript in the same of these GENERAL CONDITIONS. The prices of the bed include VAT and other taxes if any.
2. Procurement procedure: During the process of making the reservation, the user must cover some essential information for the realization of this (Name, First Surname, ID number or passport, email and Telephone). The user guarantees that he is over eighteen (18) years old and that the information he provides is true, accurate, complete and up to date. Once the payment of the reservation is made by credit card the user will receive an email with the confirmation of this. This email serves as proof of your booking. In order for a reservation to be confirmed, it is ESSENTIAL to have made the payment of the reservation. In THOSTEL SANTIAGO we work so that errors do not occur during the online reservation process, but if the user detects any error during this process, he can contact us by email at info@thostelsantiago.com
3. The cost of accommodation includes linen (cloth sheets, blankets), use of lockers, hot water in showers and toilets, use of kitchen, dining room and Wi-Fi.

3. CHECK-IN AND CHECK-OUT

1. Check-in will take place from 2:00 p.m. to 6:00 p.m. on the day of arrival (local hostel time). Outside of these hours the reception is closed and it will not be possible to check in. In case of not showing up at the hostel during this reception time, the first night will be charged (VAT and taxes included). THOSTEL SANTIAGO will freely dispose of the beds involved in the reservation. If for any reason, it is pending, part of the total amount of the reservation must be paid at the time of check-in. To check-in, all guests over 14 years of age must present an identity document with photo, driver's license or passport. Citizens from outside the European Union can only check in with their passport. (Organic Law 4/2015, of March 30, of protection of citizen security and Order INT / 502/2003 of February 21 and Order INT / 1922/2003 of July 3). In the case of groups of minors must be accompanied by adults. For adults over six years of age, one adult person for every twenty children. If they are children of six years or less, they must be accompanied by one adult for every ten children. After check-in at the hostel you will be free to enter until check-out time with a PIN code provided upon arrival.
2. The user agrees to leave the hostel before 10:00 am on the day of departure (local time of the hostel).

4. MODIFICATION OR CANCELLATION OF THE RESERVATION

If the user partially or completely cancels his reservation, cancellation may have cancellation costs, covering the costs and damages accrued by not occupying the reserved beds and canceled in advance of the expected date of arrival, as well as the expenses incurred by hiring or purchasing supplies for installation. Expenses will be charged in the following terms and conditions:

• 7 or less days before the check-in date: 100% of the reservation amount.

The refund of the amount of the reservation, by the THOSTEL SANTIAGO, with the discount of cancellation costs if any, will be made within a maximum period of 30 days (Article 14 of Decree 17/2011 of September 8).

5. PERSONAL DATA

During the online booking process, we have requested the user a series of personal data in order to provide the requested service and / or perform billing of this.

The data provided will be kept as long as the commercial relationship is maintained or during the years necessary to comply with the legal obligations (articles 66 to 70 General Tax Law). The data requested is necessary, so that if it is not provided, it will not be possible to provide the required service. The data will not be transferred to third parties except in cases where there is a legal obligation

You have the right to obtain confirmation of whether we are treating your personal data at THOSTEL SANTIAGO (ALBERGUE KM. 0 SL), therefore you have the right to access your personal data, correct inaccurate data or request its deletion when the data is no longer necessary, to the limitation of your treatment, or to oppose the treatment, as well as the right of the portability of the data.
